As of 2011, Chicago’s divorce rate stood at 7.4 percent for men and 10.2 percent for women. As a result, some residents interested in getting married in the near future — or perhaps those who have been married and are now considering divorce — may be interested in learning more about prenuptial agreements and how they influence family law matters in Illinois. A recent segment on “Fox & Friends” may provide them with valuable insight.
While discussing the importance of prenuptial agreements, a legal analyst who appeared on the show said that those who have either been married before or are older are the ones who most commonly request a marital contract. His advice for negotiating couples is to disclose their assets and liabilities in full at the beginning of marriage; this makes it easier to determine property division if it ever becomes necessary.
The end of a marriage can be a stressful time for both parties. Emotions run so high precisely because the dispute involves issues fundamental to each person’s sense of identity and well-being: alimony, child custody, property division and others. Each one can be a crisis in and of itself, and attempting to carve them down to quantifiable divorce legal issues may be an insurmountable task for anyone.
A family law attorney can help divorcing couples by providing them with an unbiased third party through which to air their grievances. As noted above, these concerns may involve various complications that neither party has taken into account; for instance, many people are unaware that property once owned solely by one party can, in some circumstances, become marital property over time. In this way, it may be possible to equitably determine property ownership, visitation plans and other hardships in a manner that leaves both parties satisfied.
